These Terms of Service ("Terms") govern your use of the GRADENIK mobile application ("the App"), operated by Ramasonik Coding ("we," "us," "our"), based in South Africa. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
GRADENIK is a self-assessment tool that walks a user through a structured set of questions about the physical condition of a comic book and returns an estimated grade, based on published industry grading conventions. GRADENIK does not physically inspect any comic. It is not a certification, authentication, or slabbing service, and it is not affiliated with, endorsed by, or connected to Certified Guaranty Company (CGC), Comic Book Certification Service (CBCS), PGX, or any other third-party grading or certification company.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a personal device, for your own personal comic book collecting purposes only.
This license does not include the right to use the App, its output, or any grade it produces as part of a commercial grading, certification, authentication, or slabbing business, service, or offering — whether paid or free to your own customers — without a separate written license from us. See Section 3.
Without our prior written consent (which may be granted only under a separate GRADENIK Engine License Agreement), you may not:
If you wish to operate a comic grading or certification business using GRADENIK's underlying engine — for example, employing insured inspectors who physically examine comics and answer GRADENIK's question set on the customer's behalf — that use is available only under a separate GRADENIK Engine License Agreement, negotiated directly with us. "GRADENIK" and the GRADENIK logo are trademarks of Ramasonik Coding. Nothing in these Terms grants you any right to use our name, trademarks, or logo, including in any way that states or implies that your product, service, or business is certified by, endorsed by, powered by, or affiliated with GRADENIK, except with our prior written permission.
GRADENIK provides an estimated grade for informational purposes only. It is not a certified grade, carries no guarantee, and is not a substitute for professional third-party physical inspection and grading. Estimates may differ from grades assigned by any certification service. We make no warranty, express or implied, regarding the accuracy of any grade produced by the App, and we are not liable for any financial or other decision made in reliance on it.
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied. To the maximum extent permitted by law, Ramasonik Coding shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising from your use of, or inability to use, the App — including any commercial or business use undertaken in violation of Section 3.
We may suspend or terminate your access to the App at any time, with or without notice, including for conduct we believe violates these Terms, such as commercial or certification use without a license under Section 3.
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles.
